The long awaited Durham Report has finally been published. The 300+ page report covered numerous aspects of the 2016 presidential elections and concluded that there were some significant flaws in both the political system and the handling of federal law enforcement agency resources, most notably the FBI.

Part of the report's conclusion was that the FBI simply pursued an in-depth investigation against Trump and any Russian collusion without going through typical FBI-led investigative measures, leading many to believe it was politically motivated.

That investigation was deemed the Crossfire Hurricane investigation.

Crossfire Hurricane

The Crossfire Hurricane investigation was an FBI counterintelligence probe initiated in July 2016. It was aimed at examining potential links between the Trump campaign and Russia's interference in the 2016 United States presidential election. The investigation sought to determine whether any individuals associated with the Trump campaign were coordinating with Russian officials to influence the election's outcome.

Crossfire Hurricane was sparked by information suggesting that a Trump campaign aide, George Papadopoulos, had been informed that Russia possessed damaging information on Hillary Clinton. The investigation was conducted by the FBI's Counterintelligence Division, and it involved surveillance, confidential informants, and the acquisition of foreign intelligence.

The probe eventually led to the appointment of Special Counsel Robert Mueller in May 2017 to further investigate Russian interference and potential obstruction of justice. The investigation remained a subject of political controversy, with supporters arguing it was a legitimate response to credible intelligence, while critics claimed it was a politically motivated "witch hunt."

Ultimately, the investigation concluded without establishing sufficient evidence of a criminal conspiracy between the Trump campaign and Russia.

The Durham Report

The Durham report found that the Crossfire Hurricane was rife with inconsistencies compared to traditional FBI investigation practices.

The Durham Report stated: "...the record in this matter reflects that upon receipt of unevaluated intelligence information from Australia, the FBI swiftly opened the Crossfire Hurricane investigation. In particular, at the direction of Deputy Director Andrew McCabe, Deputy Assistant Director for Counterintelligence Peter Strzok opened Crossfire Hurricane immediately. Strzok, at a minimum, had pronounced hostile feelings toward Trump. 23 The matter was opened as a full investigation without ever having spoken to the persons who provided the information. Further, the FBI did so without (i) any significant review of its own intelligence databases, (ii) collection and examination of any relevant intelligence from other U.S. intelligence entities, (iii) interviews of witnesses essential to understand the raw information it had received or (iv) using any of the standard analytical tools typically employed by the FBI in evaluating raw intelligence."

The Hillary Clinton Investigations

Conversely, the Durham Report mentions the Hillary Clinton probe and discussed the inconsistencies in investigative practices, as well as other alarming facts. The Durham Report concluded that investigations involving Hillary Clinton were reportedly under-investigated and produced underwhelming conclusions despite significant evidence. It also connected the findings with financial contributions to the Clinton campaign.

The Durham Report wrote: "In one such matter discussed in Section IV.B.l, FBI Headquarters and Department officials required defensive briefings to be provided to Clinton and other officials or candidates who appeared to be the targets of foreign interference. In another, the FBI elected to end an investigation after one of its longtime and valuable CHSs [confidential human source/informant] went beyond what was authorized and made an improper and possibly illegal financial contribution to the Clinton campaign on behalf of a foreign entity as a precursor to a much larger donation being contemplated. And in a third, the Clinton Foundation matter, both senior FBI and Department officials placed restrictions on how those matters were to be handled such that essentially no investigative activities occurred for months leading up to the election."

Holman Jenkins, a Wall Street Journal columnist, criticized the process entirely. In an interview, Jenkins was asked about how the FBI leadership culture played a part, he responded, "Well the question is ‘how can you expect anything else from leadership’? It’s not just this, it’s also the Hillary Clinton case. We saw that at the top level of FBI decisions are just ad hoc, politicized, they’re following the political bread crumb trail to wherever serves their bureaucratic interests. It’s hard to see how it can be any different especially in matters involving intelligence where there is no public oversight, there is no real court oversight, there is very little congressional oversight. So I think we have a real problem in the FBI that it just reached its crescendo in these two cases, both the Trump collusion case and the Hillary email case.”

Agencies and Politicization

It is difficult to fathom that a federal law enforcement agency, or any law enforcement agency for that matter, could lean towards a political preference. But considering how many elements of our society have become politicized, it is also no great surprise, just disappointing.
